Terms of Delivery and Payment

Delivery Terms

We deliver under the Standard Terms of the German Textile Industry. Delivery is made at the expense and at the risk of the buyer ex factory. Partial deliveries are permitted. The minimum order value is € 250,- (domestic). The conditions abroad depend on the respective country of destination. For orders below this value limit, a handling fee of € 15,- will be charged. For domestic deliveries, a delivery fee of € 3.95 is charged per package.  
Force majeure, strikes, operational disruptions, shortages of raw materials, etc., also at our suppliers, entitle us to withdraw in whole or in part from the purchase contract or to reasonably exceed the delivery deadlines. If information about the customer is not satisfactory, we are entitled to withdraw from the purchase contract.  
 

Delivery Proviso

Our delivery is subject to the proviso that we ourselves are supplied correctly and on time and that we are not responsible for the lack of availability. Compensation for damages is excluded unless gross negligence is involved. 
 

Replacement Delivery

If the goods you have ordered are not available, we reserve the right to send goods that are equivalent in terms of price and quality. There is of course a 14-day right of return for these goods. 
 

Deviations

Minor deviations from the samples, illustrations and dimensions without reducing the quality of the goods do not entitle the buyer, to assert warranty claims. No liability is assumed for errors or misprints in illustration or price list.
If the buyer withdraws from the purchase contract, he is obliged to pay damages in the amount of 30% of the value of the goods, without prejudice to the right to claim higher damages. This amount is due for payment immediately.

 

Prices

Our quoted prices are non-binding and are ex works. We are entitled - due to possible material price increases of our suppliers - to make price changes. The prices do not include the statutory value added tax.
 

Retention of title

The goods remain our property until full payment. If the goods are resold in the customer's business operations, the customer hereby assigns to us the claims arising from the sale in the amount of our sales price. In any case - i.e. also in the case of cash sales - he shall accept payments on our behalf and shall keep them separately.
 

Place of Fulfilment

Place of fulfilment for deliveries and payments is Dornburg-Dorndorf. Place of jurisdiction for both parties: Local Court 65549 Limburg. In principle, German law applies to all legal relationships between seller and buyer, including those transactions that are concluded abroad and / or with foreigners.
 

Terms of Payment 

All payments are to be made to us only. Our invoices are payable: 10 days after invoice date 4% discount, 30 days after invoice date net. If the payment deadline is exceeded, the currently customary interest on arrears will be charged.  
Discount deductions can only be granted, if all previous invoices due for payment have been settled.
The above delivery and payment conditions are deemed to have been accepted when the order is placed. This also applies to subsequent offers and deliveries. Terms and conditions of delivery and payment other than ours - even if they are noted- are not binding for us, unless we have accepted them individually and in writing. With the publication of this catalogue or the new price list, all previous catalogues and price lists lose their validity.

Adjustments to the GTC

STERNTALER reserves the right to amend and supplement these GTC at any time and to change their structure where necessary. The amended GTC will always be published on this website in a manner that is easily visible to you and will be deemed to have been accepted unless you object to them within one month of publication.
We therefore advise you to visit this website regularly in order to stay informed about the current status of our GTC.

These General Terms and Conditions are translated into several languages. In case of discrepancies between various language versions, the German version shall prevail.
